Less than one month after 90 Day Fiancé: Happily Ever After?star Jay Smith was taken into U.S. Immigration and Customs Enforcement (ICE) custody, he is now a free man. In Touch can exclusively confirm that Jay, 21, was released from the ICE detention center at York County Prison in York, Pennsylvania on Wednesday, July 31. On July 3, In Touch exclusively confirmed that the TLC star had turned himself in to authorities at the Upper Allen Police Department in Pennsylvania after he violated a Protection From Abuse (PFA) that was placed against him by his estranged wife, Ashley Martson, just two days prior.

But since Jay (full name: Conroy St. Christopher Smith) was not a United States citizen, he was immediately taken into ICE custody at the York County Prison.

The Jamaica native documented his journey to the United States on season 6 of the popular reality TV series, 90 Day Fiancé. Jay entered the country on a K-1 visa, a.k.a. the “fiancé’ visa, which allows the fiancé or fiancée of an American citizen to legally enter the United States under the condition that the couple would get married within 90 days. If the couple does get married within the 90-day timeframe, then the American will be able to file for an Adjustment of Status for their spouse so they can obtain a green card and remain in the United States legally. If the couple does not get married within the 90 days, the foreigner would have to return to their home country.

But Ashley, 33, and Jay struggled with trust issues very early on in their marriage after Ashley caught Jay having inappropriate conversations with other women on Tinder just days after their wedding. Because of that incident, Ashley never filed for Jay’s Adjustment of Status, which left his immigration status in jeopardy. It also didn’t help that Jay admitted to cheating on Ashley with at least two other women since he arrived in America.

Fans watched all of the drama from Jay’s second cheating scandal unfold on season 4 of the TLC spinoff, 90 Day Fiancé: Happily Ever After? In one episode, Ashley learned that Jay had hooked up with another woman in the bathroom of a local barbershop where he had been working as a tattoo artist. The woman happened to be one of Jay’s female clients, and Ashley had even met the other woman before their hookup.

The couple tried to make their marriage work, but in April, Ashley accused Jay of cheating on her again on her Instagram Story. Shortly after she accused Jay of cheating, Ashley filed for divorce for the second time.

In the following months, the drama from Ashley and Jay’s nasty divorce spilled over into social media. Eventually, the drama led to Ashley file for a PFA against Jay, which was later granted.

Per the terms of the PFA, Jay was not allowed to post about Ashley or the PFA online. According to a statement posted on the Upper Allen Township Police Department’s website, Jay violated those terms. “On July 2, 2019, Upper Allen Police investigated a report of a PFA violation. The protected party lives in Upper Allen Township and reported a social media post made by Smith, which was in violation of the order,” the statement read. “As a result of the investigation, an arrest warrant was obtained for Smith. On July 3, 2019, Smith was taken into custody without incident. Smith was transported to the Cumberland County Prison for processing and arraignment. A hearing will be held at a later date.”

Jay’s PFA hearing took place on July 17, where he was represented by an attorney, his friend Kayla O’Brien exclusively revealed to In Touch at the time. At the hearing, Jay was found guilty of violating the PFA and was “sentenced one day and a $100 fine for the violation over the Instagram post,” Kayla explained.

But Jay’s estranged wife, Ashley, exclusively told In Touch that after the hearing, Jay was “sent back to the ICE detention center where he will wait to be deported.”

In a big turn of events, Jay was released from ICE custody just two weeks after his hearing by his employer, the owner of Ego Ink tattoo shop in Lemoyne, Pennsylvania. Jay’s boss, who goes by the name Ego, posted a photo to his Instagram Story on Wednesday, July 31, featuring a check in an envelope for $4,500 — the amount of Jay’s bail. Ashley and Kayla both exclusively confirmed to In Touch that Jay was bailed out of prison and was released from ICE custody.

Jay’s sister, Poochie, seems elated that her brother was released, and she took to her Instagram Story to share her excitement — while seemingly throwing shade at her estranged sister-in-law. “When Jesus say yes, nobody can say no!! Suck it!! There is no limit to what you can do, lord,” she wrote.
