Even though Ashley Marton‘s estranged husband Jay Smith was found guilty of violating a Protection From Abuse (PFA) order earlier this week, their divorce has not been finalized yet. The 90 Day Fiancé star, 32, took to her Instagram Story on Saturday, July 20, to share an update on her divorce from Jay, 21, and she explained why they still are legally married even though they are no longer together. Since the hit TLC reality TV series is filmed months in advance, the storyline on 90 Day Fiancé: Happily Ever After? season 4 is not the most up to date version of Ashley and Jay’s timeline.

The scene where Ashley filed for divorce from Jay that fans watched on season 4 actually took place in January. Less than two weeks after that first filing, she withdrew the paperwork.

But as In Touch previously reported, Ashley filed for divorce for the second time in April 2019.
Since then, Jay moved out of Ashley’s home but a whole lot of drama went down between the exes.

On Monday, July 1, Ashley obtained a PFA from Jay. But just days later, Jay allegedly posted about Ashley and the PFA on Instagram, which was in direct violation of the order. Because of the alleged violation, local law enforcement issued a warrant for Jay’s arrest.

Insiders exclusively revealed to In Touch at the time that once Jay learned about the warrant, he turned himself in to the Upper Allen Police Department in Pennsylvania.
Jay’s friend, Kayla O’Brien exclusively revealed to In Touch that Jay was “sentenced one day and a $100 fine for the violation over the Instagram post,” or essentially time served since he had already been in custody for about two weeks.

But Ashley exclusively revealed that Jay is still facing deportation after his PFA sentencing. “He was sent back to the ICE detention center where he will wait to be deported,” she told In Touch.

But if Jay is sent back to his native country of Jamaica, there is one very big thing that is keeping Ashley tied to Jay: the former couple is still legally married because Ashley claims Jay refuses to sign their divorce papers.

During an Instagram Q&A, Ashley explained to a fan that Jay has 90 days to sign the paperwork and she revealed why she thinks he is holding out.

“He is requesting half of everything I own, that’s why he won’t sign,” Ashley wrote.

But Ashley made it clear that Jay would not be getting half of her assets in their divorce.

“My attorney is a savage. You should see the cease and desist letters that just went out 😳. I’m not worried about anyone taking anything. I may have made a bad decision, but I’m not stupid. I guess being burned in the past helped me in this situation,” Ashley wrote. “A little advice from me is to save EVERYTHING!!! Receipts don’t lie. I saved it all from Day 1 and thank god I did. If your significant other goes through your phone, email the stuff to an email they don’t know about. Be smart!”
