It’s a serious situation. Jay Smith (real name: Conroy St. Christopher Smith) shared a cryptic video to his Instagram Stories on Tuesday, July 2, hours before he was taken into the custody of the United States Immigration and Customs Enforcement (a.k.a ICE). The TLC alum, who is currently facing deportation, posted a clip showing the lyrics from Lil Durk’s single called “Turn Myself In.”

“I wish I would turn myself in before I f–k one last time / I wish I would turn myself in before I pour up one pint,” the 15-second video he posted began. “I wish I would turn myself in without kissin’ my kids, no, it ain’t right. I wish I would turn myself in without playin’ that s–t back that night.”

Jay, 21, turned himself into authorities on Wednesday, July 3, after learning he had a warrant out for his arrest, a source told In Touch exclusively, due to an alleged violation of a PFA (Protection From Abuse) order that was placed against him by his estranged wifeAshley Smith (née Martson), on Monday, July 1. As of now, Jay is being detained in York County Prison in Pennsylvania.

On July 2, Upper Allen Police investigated a report of a PFA violation following a social media post made by Jay. It’s unclear which post was in violation. As a result of the investigation, an arrest warrant was obtained and he was taken into custody the following day. Jay was transported to the Cumberland County Prison for processing and arraignment with a hearing scheduled for a later date.

The Jamaica native still has a chance to appeal, but if Ashley provides “evidence” that he used her for a green card, then he’ll probably be deported to his home country.

As viewers saw, Ashley, 31, discovered that he had been unfaithful a second time on the emotional June 23 episode of the spinoff, 90 Day Fiancé: Happily Ever After? She later kicked him out of her home on the June 30 episode, and called the police to report that he had been in America illegally.

However, we don’t know the details about what led to her filing the PFA, which he allegedly violated — leading to his arrest warrant. That’s why he turned himself in and is in ICE custody now.

“Jay remains in custody as the deportation process can take 6-8 months,” according to the new statement provided to In Touch from Jay and Ashley’s representative. “Ashley is in New York and is going to take the 4th of July holiday to focus on herself and her kids, and just try not to worry about it. They’ll both be in court on Tuesday [July 9] and Wednesday [July 10].”
