In Touch has exclusively learned Kim Kardashian secretly testified under oath about the details of her husband Kanye West‘s November 2016 breakdown and hospitalization in the rapper’s nasty legal battle with his insurance company, which has refused to pay up after the cancellation of much of his Saint Pablo tour.

Kanye filed suit against insurer Lloyd’s of London on Aug. 1, claiming breach of contract and asking for a jury trial. The new issue of In Touch reveals new details about Kanye’s breakdown, what caused it and his battle with Lloyd’s of London. “Kanye wanted the insurance to pay $10,812,997.09 plus fees for the cancellations,” a source explains to In Touch. But the insurance company denied payment, saying his breakdown was brought on by drugs. Now Kanye is seeking the money — plus unspecified damages — in his lawsuit.

The fight with the insurance company includes haggling over video footage that Kanye’s team worries could destroy his marriage to Kim, the source tells In Touch. “More than 20 hours of video was taken of Kanye during the four days leading up to his hospitalization, and you see the deterioration of his condition and his mental breakdown,” the source tells In Touch exclusively.

Kanye underwent an independent medical examination on Dec. 9 and 10 and was questioned under oath by the insurance company on Feb. 1, 2017. Kim testified on Dec.13, 2016. She was questioned about Kanye taking Percocet for a short time, with a valid prescription.

The rapper’s lawyers are claiming that he should get a payout because doctors determined he was unable to perform and it had nothing to do with his drug and alcohol use. Behind the scenes, they’ve hammered the insurance company and accused Lloyd’s of citing every possible exception in the coverage while ignoring relevant facts.
