Ciao! Joe Giudice will be released from ICE custody and will be heading back to his home country of Italy, In Touch can confirm. The 47-year-old has been in an ICE detention center since his release from federal prison in March after serving a three-year sentence for fraud. As he is in the process of appealing his deportation case, he was granted a request on October 3 to wait it out in his home country rather than behind bars.

Previously, Joe’s request for bond to wait out his verdict in New Jersey was denied on September 20, despite pleading with an immigration judge to be released from ICE custody. Thankfully, his request was approved this time around, but the catch is he has to wait it out in Italy.

In Touch previously reported that the former Real House Wives of New Jersey star was released from his 41-month prison stay for mail, wire and bankruptcy fraud charges on March 14. Since Joe is not a United States citizen, he is facing the possibility of deportation back to his native country of Italy after he served his time.

Wife, Teresa Giudice, wrote a personal letter to the judge begging him to let Joe stay in the states so that he could continue to watch their four daughters ⁠— Gia, 18, Gabriella, 15, Milania, 14 and Audriana, 10 ⁠— grow up.

“I cannot bear the thought of my daughters losing their father, I am fearful that it will break them and that I alone will not be able to fix them,” the 47-year-old wrote. “Judge Ellington, this is my greatest fear and it keeps me up at night. The fear that if I lose my husband, I will also lose my children, as they will never ever be the same.”

In October 2018, Judge John Ellington found Joe eligible for deportation after his sentence. “Based upon the law, I find you deportable and ineligible for any kind of relief,” adding, “Mr. Giudice, no matter how this turns out, I wish you the best. I decided this case as a matter of law.” Since the court ruling, Joe has been waiting in ICE custody and trying to appeal the court ruling.

An insider exclusively told In Touch back in April that Joe’s legal battles have not been easy on Teresa. “Teresa wants to move on with her life, but due to Joe’s deportation case it’s not that easy! It’s been over three years since Joe was sent to jail for fraud so it’s not surprising that Teresa feels like she doesn’t have a husband,” the source revealed. Only time will tell if Joe will ever be able to come home to New Jersey.
