Denise Richards Takes Legal Action to Remove Aaron Phypers From Former Home, Cites Damage and Unpaid Rent

Denise Richards is in a legal battle to regain access to her former home—and she wants her ex, Aaron Phypers, out immediately.

According to court documents obtained by Us Weekly on Wednesday, August 20, Richards, 54, filed a declaration asking a judge to remove Phypers, 52, and his family from the house they once shared during their marriage. The filing comes so she can return to the property to retrieve personal belongings she left behind when she moved out more than two years ago.

“When I moved out over two years [ago], I left many of my personal items and my late mother’s items at the house based on Aaron telling me that his family would be moving back to Canada and we would be moving back into the [home],” the documents read.

Richards’ dogs have allegedly been at the property since May while she recovered from two surgeries, a situation she claims Phypers had agreed to.

However, Richards says she recently received a message from the landlord saying eviction proceedings would begin Saturday, August 23, because Phypers had not been paying rent or responding to communications. According to Richards, she had informed Phypers back in January that he would be responsible for the home’s payments.

In her filing, Richards expressed concern that her belongings might be damaged and requested to retrieve them—and her pets—without Phypers present. She also alleged that “Aaron and his parents and brother have severely damaged” the home, which she described as being “in a state of disarray.” Images she submitted reportedly showed patches of removed flooring, scattered boxes, clothing and papers.

Richards asked the court that Phypers and his family not be present during her visit on Saturday and that no recording or listening devices be allowed on the property.

Phypers responded on Wednesday, stating he does not “consent to [the] order requested” by Richards.

“There is no emergency or exigent circumstance and the court should deny [her] ex parte request,” the documents read. He added that if the court were to grant Richards’ order, he would like the “opportunity to retrieve” his own “personal belongings” from the former residence.

The couple’s divorce filing came in July after seven years of marriage, with Phypers citing “irreconcilable differences.” Shortly after the split became public, Richards accused Phypers of physical abuse and requested a restraining order.

Phypers denied the claims in a statement to Us Weekly: “Let me be unequivocally clear: I have never physically or emotionally abused Denise — or anyone. These accusations are completely false and deeply hurtful. Denise and I, like many couples, have faced our share of challenges, but any suggestion of abuse is categorically untrue. I have always tried to approach our marriage with love, patience, and respect. I ask for privacy as we navigate personal matters, and I hope that the public and media will refrain from spreading harmful and baseless claims.”
