They’re already engaged, so what’s next? 90 Day Fiancé: Before the 90 Days stars Rachel Bear and Jon Walters’ sweet proposal was featured on last week’s episode of the hit TLC reality TV series — which made them the first out of the new Season 2 cast members to get engaged! But now they’re facing a huge obstacle — with Jon’s criminal record, it will be very difficult for him to gain entry in the United States from his home country of England. Now, in a clip from tonight’s episode, Jon and Rachel sit down with a lawyer to discuss their options. 

“We were talking about the K-1 visa and we discussed it back and forth and a huge part about why we are doing it this way is because I don’t want to ask permission, I want to be able to fight for the right to be with my wife,” Jon said via video call.

The lawyer said that after reviewing Jon’s record, she agreed with him that their best option for Jon to be able to enter the United States would be a marriage-based K-3 visa or an immigrant visa instead of the fiancé visa. With Jon’s criminal record, it would be easier for him to get denied entry into the United States as a fiancé of an American citizen but he has a shot of getting approved for a spousal visa if he would already be legally married to Rachel.  

But while the K-1 visa would take a shorter amount of time to process with a higher risk of getting denied, the spousal visa would have a higher chance of possibly getting approved but the wait time would be about three years before he could legally move to the United States. That’s the biggest issue, because Rachel does not want to be physically apart from Jon that long.

“I don’t care,” Jon said when told that he would have to wait about three years before being able to start his life with Rachel as husband and wife. “It’s just time. We’re going to be together, so just being with Rach and married — that’s all that matters to me at the moment.” Fans will have to keep tuning in to find out what happens next and impatient fans can read our 90 Day Fiancé spoilers to find out if Jon and Rachel ever make it down the aisle!
