According to new legal documents filed by Walmart in regards to Tracy Morgan’s horrific accident that occurred in June, the actor is to blame for his injuries because he wasn’t wearing a seatbelt at the time of the crash.
The super-store is claiming that his lack of seatbelt is to blame for most, if not all, of the Saturday Night Live alum’s injuries, the report explains—despite the fact that his vehicle was struck by the Walmart truck, which was operated by a driver, Kevin Roper, who had clocked in more than consecutive 10 hours behind the wheel.

The accident not only left the 45-year-old with serious injuries (he broke his leg, femur, nose and several ribs), but also killed his friend, James “Jimmy Mack” McNair.
Jimmy previously sued Walmart, saying they were responsible for the crash by allowing their driver to be on the road for 10 hours straight—after being awake for more than 24 hours.
