The truck driver who allegedly caused the accident that led to the death of one passenger and sent Tracy Morgan and three others to the hospital has been charged on Saturday, June 7.
Middlesex County Acting Prosecutor Andrew C. Carey and Col. Joseph R. Fuentes, superintendent of the New Jersey State Police, announced Kevin Roper, 35, of Jonesboro, G.A., was charged with one count of death by auto and four counts of assault by auto.
James McNair, 62, of Peekskill, N.Y., was pronounced dead at the scene at 1:53 a.m. while the four other passengers, including Morgan, were airlifted to the hospital.
Bail was set at $50,000 for the tractor-trailer driver, who is expected to surrender.
The cause of the crash remains under investigation.

Tracy Morgan is now in critical condition after being part of a six-vehicle car accident that happened early Saturday morning.
According to reports, Tracy was riding in a limo bus when it overturned around 1 a.m. on the New Jersey Turnpike Exit 7A. The cause of the accident was from a dozing truck driver who didn't see traffic slowing down.
"Preliminary investigation findings revealed that a tractor trailer driven in the middle lane by Kevin Rooper, failed to observe slow moving traffic ahead of him. When the driver did notice the Mercedes passenger limo ahead of him it was too late," Sgt. Gregory Williams of the NJ State Police tells In Touch.
“Just prior to impact he swerved to the left in an attempt to avoid the collision, but was unable to and struck the rear of the Mercedes, which caused it to rotate clockwise and overturn.”
The accident also involved two tractor-trailers, two cars and one SUV. One person identified as James McNair, a comedy writer for Morgan, was sadly killed and seven others have been hospitalized with injuries.
Three people are currently in critical condition – the 30 Rock actor being one of them – and another is in fair condition. All are being treated at the Robert Wood Johnson Medical Center in New Brunswick, N.J.
The 45-year-old actor was last performing at the Dover Downs Hotel and Casino in Delaware on Friday night, hours before the incident occurred.
