While Khloé Kardashian says that Lamar Odom doesn’t know the details of how he ended up in the hospital — saying he just knows he sustained a brain injury — he may be in for a rude awakening, as a new report by TMZ claims he may still be charged with cocaine possession.
It was previously reported that he faced the possibility of prosecution if a court-ordered drug test proved he used the illegal substance — and now the Nye County District Attorney must decide how to proceed.

District Attorney Angela Bello tells TMZ that her office is considering filing criminal charges against the basketball player, 36 — while they are unsure if it’ll be possession of cocaine or being under the influence of a controlled substance.
While TMZ notes they were unable to find a case where someone who overdosed and landed in the hospital was actually prosecuted for possession — the Nye County Sheriff’s office says they have definitely referred such cases to the D.A., though it’s ultimately up to the district attorney to actually advance to prosecuting.

Because of his current situation — his cognitive function has been significantly impaired — the report speculates, even if he were charged, he may not be competent to stand trial.
