Nice try. Jared Fogle, aka the Subway guy, is currently trying to appeal his 15-year sentence after pleading guilty to child pornography charges — by having the judge assigned to his case removed because she was a mom.

According to TMZ, Jared’s latest attempt to get an earlier release date failed, after his motion to dismiss Judge Tanya Walton Pratt, who imposed a longer sentence on Jared in 2015 then requested by the prosecution, failed after he claimed the fact that she had two teenage daughters made her biased. “All judges in this court have children, as do countless other members of our nation’s judiciary,” the ruling read. “Requiring recusal solely because a judge is a parent would hamstring the judiciary and depart from precedent that requires specific indicia of bias towards a party.”

The court also shut down his claim that he was incorrectly charged with conspiracy by prosecutors. Just give it up, Jared. Three years ago, the spokesperson, then known for his impressive weight loss thanks to his love of $5 footlongs, was sentenced to 15 years behind bars for child pornography and crossing state lines to pay for sex with a minor. He was also required to pay $1.4 million in restitution to 14 victims. At the time of his arrest, Subway released a statement quickly distancing themselves from the TV personality. “Jared Fogle’s actions are inexcusable and do not represent our brand’s values,” the fast food chain said in a Facebook post. “We had already ended our relationship with Jared.”

Since then, Jared has been in and out of appeals court. Last November, Judge Pratt denied his argument that the federal court did not have jurisdiction to convict him. He was also reportedly beaten up in a prison ambush in 2016. According to reports, Jared suffered a “bloody nose, swollen face, and scratches on his neck” from the attack and was unhappy with his low-security prison. As of now, his projected release date is listed as July 11, 2029.
